1. Acceptance of Terms

By accessing or using Kalgo ("the Service"), operated by Kalgo Holdings LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including trial users, monthly subscribers, and lifetime license holders.

2. Description of Service

Kalgo provides access to a proprietary NQ futures trading algorithm ("the Algorithm") distributed as a TradingView Pine Script indicator and/or NinjaTrader strategy. The Algorithm is licensed to Kalgo Holdings LLC by Stellar Ventures LLC. We provide access to this algorithm, related documentation, and community support through our platform.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service. One account per person — creating multiple accounts to circumvent trial limits is prohibited.

4. Subscriptions and Payment

• Free Trial: New accounts receive 90 days of TradingView access to the algorithm at no charge. No credit card is required for the trial.
• Monthly Subscription ($149/month): Billed monthly, auto-renewing. Cancel anytime; access continues until the end of the billing period.
• Lifetime License ($2,499 one-time): Permanent access to the algorithm and all future updates. Payment is final and non-refundable.

Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (for monthly plans). Prices are in USD and do not include applicable taxes.

5. Refund Policy

Monthly subscriptions include a 90-day free trial period. No refunds are issued after a subscription payment is made. Lifetime licenses are non-refundable. We reserve the right to provide courtesy refunds at our sole discretion in exceptional circumstances.

6. License and Intellectual Property

We grant you a personal, non-transferable, non-exclusive license to use the Algorithm for your own trading purposes. You may not: copy, distribute, sell, sublicense, or reverse-engineer the algorithm; share your account credentials or TradingView access with others; use the algorithm in a managed account service or signal service without written permission.

The algorithm and all related intellectual property remain the exclusive property of Stellar Ventures LLC. These Terms do not transfer any ownership rights to you.

7. Trading Risk Disclaimer

Futures trading involves substantial risk of loss. Past performance of the algorithm is not indicative of future results. The Algorithm does not guarantee profits and may result in losses. You are solely responsible for your trading decisions and any resulting financial outcomes. See our full Risk Disclaimer.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE ALGORITHM WILL BE PROFITABLE, ERROR-FREE, OR UNINTERRUPTED. USE OF THE SERVICE IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KALGO HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING TRADING LOSSES, LOSS OF PROFITS, OR DATA LOSS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or chargebacks. Upon termination, your access to the algorithm will be revoked. No refunds are issued for terminations due to Terms violations.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Florida.
